Terms of Service
Last updated: March 2026. These terms govern your access to and use of Moko Sales.
1. Agreement
By creating an account, accessing, or using Moko Sales (the "Service"), you agree to these Terms of Service ("Terms"). If you use the Service on behalf of a company, you represent that you have authority to bind that company. If you do not agree, do not use the Service.
2. The Service
Moko Sales is provided by Mokoapp (mokoapp.net). We may change, suspend, or discontinue features with reasonable notice where practicable. We are not responsible for third-party services or integrations you choose to use with the Service.
3. Accounts and security
You must provide accurate registration information and keep your credentials confidential. You are responsible for activity under your account. Notify us promptly at hello@mokoapp.net if you suspect unauthorized access.
4. Customer content
You retain ownership of data you upload (e.g. call recordings, transcripts metadata). You grant us a limited license to host, process, and analyze that content solely to provide and improve the Service as described in our Privacy Policy. You represent that you have the rights and consents needed to upload content, including recordings of calls, for processing.
5. Acceptable use
You will not misuse the Service: no unlawful activity, no attempting to breach security, no scraping or overload of systems beyond normal use, and no use that infringes others' rights. We may suspend or terminate access for violations.
6. Fees
Paid plans, billing cycles, and taxes are as shown at signup or in your order. Failure to pay may result in suspension. Unless stated otherwise, fees are non-refundable except where required by law.
7. Confidentiality and AI output
Coaching scores, summaries, and suggestions are generated to assist your team and are not legal, financial, or professional advice. You remain responsible for business decisions and compliance with applicable laws (including call-recording and employment rules).
8. Warranties disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law.
9. Limitation of liability
To the maximum extent permitted by law, Mokoapp and its suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Our aggregate liability for claims arising from the Service in any twelve-month period is limited to the fees you paid us for the Service in that period (or fifty euros if you use a free tier).
10. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or risk to the Service or others. Provisions that by nature should survive (e.g. liability limits, governing law) will survive termination.
11. Governing law
These Terms are governed by the laws applicable in the jurisdiction of Mokoapp's establishment, without regard to conflict-of-law rules, except where mandatory consumer protections apply in your country.
12. Changes
We may update these Terms. We will post the revised version and update the "Last updated" date. Continued use after changes constitutes acceptance. Material changes may be communicated by email or in-product notice.
